Just in case, you or anyone looking at this don't know, none of us are entitled to a view that we have from a property. This does not mean however that important views in a Conservation area are not protected, they are. You have reason to be concerned about the relationship between the Estate Agent that sold you your home, and the developer wishing to build opposite it. We hope you can resolve this, and that you let us know what is happening here. Building a large mutli-storey car park right in front of your home would be un-neighbourly, and it would be irrational for Councillors to approve it. I am sure Mr Style will remedy your concerns now that he is aware of the problem.

They believe that at the date they showed the house, which was put under offer to you in September 2004, all they new of our plans at that time was that we were in process of working up a masterplan for the Phoenix Quarter area. We were not at that time contemplating building a car park in the location now shown on the plans, at that time we were proposing to locate a hotel on that part of the site. This plan was then at the very early stages and it was unclear as to how long it would take to go through the planning process or whether it would proceed. The advice sought from Lewes Estates at that time was of a very general nature and did not involve a formal valuation. They recollect informing prospective purchasers at that time that should a new development take place on the Phoenix site that property prices and the desirability of property in Green Wall would actually benefit from the proximity to new buildings rather than being next to an unattractive soap factory. They still of that view. It should also be pointed out that it would have been incumbent upon your solicitors to inform you of any planning applications for new development in the area.

Dear Robert (Nettleton, Managing Director of Lewes Estates) I would refer you to the Lewesmatters.co.uk website and a discussion with Angel Property regarding Lewes Estates’ sale of a property to my wife and I on Green Wall in 2004. Apparently there had been discussions between Angel Property and Lewes Estates about the proposed development before this date. I suggest, if necessary, we have a meeting to discuss this – arranged with my solicitor who handled that purchase, and who forwarded your sales commission. There seems to be some misinformation being circulated regarding what Lewes Estates claims was informed to prospective purchasers regarding a forthcoming development and I’d like to get to the truth of this matter please. The first my wife and I knew of ANY proposed development for that site was when Angel Property had their first ‘exhibition’ in the old garage last year. You can imagine the shock, worry and disappointment this knowledge has caused since. Obviously I’d like some explanation from you I attach your sales e-details PDF received at the time we viewed and bought. Kind Regards

How can a search reveal a planning application if is being discussed by a developer and an Estate Agent selling a neighbouring property, but hasn't been submitted.

Re:Lewes Estates and Angel Property - 2006/04/26 01:27I would also add, that the Soap Factory may not be pretty and I imagine is rather caustic, but it provides jobs, is low rise, it even occassionally smells nice! Is it one of the businesses that is going to be relocated in Malling, perhaps anyone who knows could tell us ? I am sure that now that this problem has been raised that Angelproperty will ensure that Simon does not find himself facing a car park, or the service access to a hotel but an attractive low rise riverside building at this important gateway site to Lewes.

Re:Lewes Estates and Angel Property - 2006/04/26 02:22Dear Simon, I wish to make it absolutely clear , I have had nothing to do with your dealings with Lewes Estates, all I have tried to do is to get a clear view as to what they knew or did not know of our development plans at the time you purchased your house. I will now leave you to get on with discussing the matter with them and in forming a view as to whether they mislead you in any way. I am certainly nothing to do with Lewes Estates or their business and do not wish to get involved further here.
The issue of whether it is resonable to be able to build the building we are proposing in the location we are proposing to build it will be left to the planners and the planning committee. We will produce a daylighting study and a massing study in order for them to assess whether we are contravening your rights.
As I have previously stated we will keep an open mind about our proposal and will inform you when we have got the daylighting study finalised in order for you and us to better understand the impact of the proposed new building.
