Re:Lewes Estates and Angel Property - 2006/04/26 16:44 My thanks to S.Oliver for some common sense commentary - I certainly have no problem with my neighbours in the Soap Factory and it's workforce whom I often meet outside my own propertry - and it is is already smelling much better than some of the dealings highlighted in this chain of message posting!

Your grievance concerning information given at the time of purchase of your house in 2004 concerns Lewes Estates with whom you were dealing, and not Angel Properties. Angel had no obligation to inform you anymore than anyone else, although you have every right to fight Angel's proposal along wiht anyone else.

I am no expert on Estate Agency law, but Lewes Estates while acting on behalf of the sellers, would also have duties (including I expect confidentiality) owed towards to other clients eg Angel Properties. The answering of questions in relation to a property purchase on which you have comeback is done by the seller not the estate agent. Consider if the seller had knowledge and check the answers given in the pre-contract questionaire.

What would also concern me, is that your solicitor's local search to LDC as to any outstanding applications would not have thrown this up, if at that stage no application had been submitted. HOWEVER, if at that time Angel were already in confidential discussions with LDC about the development, then LDC had knowledge, but this did not show up on your local search. This maybe a flaw in the search process but when consulting your solicitors about Lewes Estates, I see no point in you trying to target Angel, but do consider the position vis a vis LDC who may have had actual knowledge, but no routine duty to disclose.

Re:Lewes Estates and Angel Property - 2006/04/26 18:44 In early 2005 I was in discussions with Robert Nettleton of Lewes Estates re the sale of my property.
He advised me to move due to planned development on the Phoenix site and offered to let me see the plans at his office.
At that time nothing was in the public domain and I thought he was exaggerating the threat in order to secure my business. My mistake!

I am a lawyer though my area is commercial litigation not property. Always remember that free advice is worth what you pay. My comments should be taken as friendly suggestions and not to be relied on in place of professional advice.
