| You may also hear it referred to as planning gain, planning contributions, or community benefit.These are all different names for the same mechanism. A section 106 agreement is a commitment made by the developer to the local authority to address,by way of works,payment or other contribution,the impact of the development.These can be secured through a legal agreement negotiated between the planning authority and the developer.They can be used to prescribe the nature of a development (e.g by requiring a proportion of affordable housing);they can compensate for loss or damage (eg loss of open space) or they can mitigate an impact (eg more people will equal more car jouirneys unless there is an increase in public transport provision).Section 106 aims for the developer to pay for costs associated with new developments,rather than the council, and, therefore, local people. |
